Producer Logic, LLC and its affiliates (collectively, "Producer Logic," "we," "our," or "us") respect the privacy of users of our website, including its subdomains (the "Site"), our social media pages and accounts (collectively, "Social Media"), and the Producer Logic software platform and related services (the "Producer Logic Platform" or "Platform").

The Site, Social Media, and Producer Logic Platform are collectively referred to in this Privacy Policy as the "Services."

This Privacy Policy describes our practices regarding information that we may collect, receive, use, process, store, disclose, or otherwise handle when you visit, access, interact with, or use our Services.

IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT ACCESS OR USE THE SERVICES OR PROVIDE PERSONAL INFORMATION TO PRODUCER LOGIC.

You acknowledge that, except where information is required to provide the Services or fulfill contractual or legal obligations, you voluntarily provide Personal Information to Producer Logic.

Where applicable law requires a legal basis other than consent, Producer Logic may process Personal Information as necessary to perform a contract, comply with legal obligations, protect legitimate interests, prevent fraud, protect security, establish or defend legal claims, or as otherwise permitted by applicable law.

We may use third-party authentication services. Passwords may therefore be maintained by our authentication provider rather than directly accessible to Producer Logic.

When you communicate with Producer Logic through email, telephone, forms, Social Media, support requests, demonstrations, or otherwise, we may collect:

3. CUSTOMER-SUBMITTED INSURANCE AND BUSINESS DATA

The Producer Logic Platform is designed to assist insurance professionals with commercial-insurance research, risk analysis, coverage considerations, underwriting preparation, carrier appetite identification, and related producer activities.

Accordingly, Customers and Authorized Users may submit information concerning businesses, insureds, prospects, risks, or commercial accounts ("Customer-Submitted Insurance and Business Data").

This information may include:

  • business or prospect name;
  • business address;
  • state or geographic location;
  • industry;
  • business sector;
  • business description;
  • operations;
  • years in business;
  • NAICS codes;
  • SIC codes;
  • annual revenue;
  • payroll;
  • number of employees;
  • number of locations;
  • property values;
  • building information;
  • vehicle information;
  • equipment information;
  • business exposures;
  • products;
  • services;
  • contractual exposures;
  • insurance coverage information;
  • policy information;
  • limits;
  • deductibles;
  • loss information;
  • claims information;
  • risk-management information;
  • requested coverage;
  • underwriting information; and
  • other business information entered into the Platform.

Customer-Submitted Insurance and Business Data may constitute Personal Information when it identifies or can reasonably be associated with an individual.

3.1. Customer Responsibility for Submitted Data

CUSTOMER IS RESPONSIBLE FOR THE INFORMATION CUSTOMER AND ITS AUTHORIZED USERS SUBMIT TO PRODUCER LOGIC.

Customer represents and warrants that Customer has all rights, licenses, permissions, authorizations, and consents necessary to collect, use, disclose, upload, transmit, and otherwise process Customer-Submitted Insurance and Business Data through the Producer Logic Platform.

Customer should not submit Personal Information that is unnecessary for the requested analysis.

Customer is responsible for complying with applicable:

  • privacy laws;
  • data-protection laws;
  • insurance regulations;
  • confidentiality obligations;
  • contractual obligations;
  • cybersecurity requirements; and
  • professional obligations

applicable to information Customer submits through the Platform.

Producer Logic does not independently verify whether Customer has obtained all permissions or authorizations necessary to submit information to the Platform.

4. INFORMATION COLLECTED THROUGH TECHNOLOGY

We and our authorized service providers may automatically collect certain information when you access or use the Services.

4.1. Identifiers

We may collect online identifiers such as:

  • Internet Protocol ("IP") address;
  • device identifiers;
  • browser identifiers;
  • session identifiers;
  • advertising identifiers, where applicable;
  • authentication identifiers; and
  • other unique or pseudonymous identifiers.

These identifiers may be used for:

  • authentication;
  • security;
  • fraud prevention;

  • troubleshooting;

Unless specifically disclosed and enabled, Producer Logic does not require precise GPS location information to provide its core Platform functionality.

We may collect information regarding how Users interact with the Site and Platform, including:

  • buttons clicked;
  • session duration;
  • browser characteristics;
  • device characteristics;

If Technical and Behavioral Information becomes linked to an identifiable individual, we will treat it as Personal Information as required by applicable law.

Producer Logic uses or may use artificial intelligence, machine learning, large language models, retrieval technologies, proprietary databases, algorithms, rules engines, and related technologies to provide Platform functionality.

Depending upon the functionality used, information submitted to the Platform may be processed to generate:

  • coverage recommendations;
  • coverage considerations;
  • underwriting questions;
  • carrier appetite information;
  • potential market recommendations;
  • market rankings;
  • carrier scores;
  • endorsement suggestions;
  • common-claim information;
  • cross-selling opportunities;
  • risk-management recommendations;
  • renewal considerations;
  • account summaries;
  • producer talking points;
  • industry classifications;
  • NAICS/SIC classifications; and
  • other Output Data.

7.1. Third-Party Artificial Intelligence Providers

Producer Logic may use third-party artificial intelligence providers, model providers, API providers, cloud-computing providers, and related technology providers to process information necessary to generate requested Platform functionality.

When required to provide a requested Service, information submitted by a Customer may be transmitted to or processed by such providers in accordance with applicable agreements, configurations, privacy terms, and data-processing arrangements.

Producer Logic will use commercially reasonable efforts to select service providers appropriate for its business requirements.

However, third-party services are controlled by their respective providers and may be subject to their own privacy, security, retention, and processing practices.

7.2. AI Accuracy

Artificial intelligence systems may produce inaccurate, incomplete, outdated, inconsistent, or unexpected results.

This Privacy Policy addresses how information is handled. The accuracy and appropriate use of AI-generated Output Data are addressed separately in Producer Logic's Terms of Service.

7.3. Model Training and Product Improvement

Producer Logic may use aggregated, anonymized, or de-identified information to analyze usage, improve Platform functionality, evaluate performance, develop features, and improve Producer Logic's proprietary systems, subject to applicable law.

Producer Logic will not represent that identifiable Customer Data is excluded from third-party model training or retained under particular AI-provider terms unless such restriction is supported by Producer Logic's then-current technical configuration and contractual arrangements with the applicable provider.

Producer Logic may update this Privacy Policy as its artificial intelligence infrastructure and providers evolve.

8. CARRIER APPETITE AND INSURANCE MARKET DATA

Producer Logic may collect, store, organize, analyze, combine, or display information concerning:

  • insurance carriers;
  • MGAs;
  • MGUs;
  • wholesalers;
  • program administrators;
  • insurance products;
  • underwriting appetite;
  • NAICS classifications;
  • SIC classifications;
  • account size;
  • revenue thresholds;
  • geographic restrictions;
  • state restrictions;
  • preferred characteristics;
  • risk characteristics;
  • underwriting questions;
  • red flags;
  • hard declines;
  • coverage appetite;
  • market availability;
  • source information;
  • source dates; and
  • related insurance-market information.

This information may originate from:

  • publicly available sources;
  • insurance carriers;
  • carrier websites;
  • underwriting materials;
  • MGAs;
  • wholesalers;
  • industry sources;
  • licensed data sources;
  • third parties;
  • Producer Logic research;
  • historical information;
  • Customer inputs; and
  • artificial intelligence-assisted analysis.

Carrier appetite and insurance-market information is primarily business information rather than Personal Information. To the extent such information includes Personal Information, Producer Logic will process that Personal Information in accordance with this Privacy Policy.

Carrier appetite information and market recommendations are subject to the separate disclaimers and limitations contained in Producer Logic's Terms of Service.

9. COOKIES AND SIMILAR TECHNOLOGIES

When you access or use the Site or Platform, Producer Logic and authorized service providers may use cookies, web beacons, pixels, tags, local storage, software development kits, and similar technologies (collectively, "Cookies").

Cookies may enable us to:

  • recognize a User or device;
  • authenticate Users;
  • remember preferences;
  • maintain sessions;
  • improve performance;
  • personalize the Services;
  • understand Platform usage;
  • perform analytics;
  • determine approximate geographic location;
  • prevent fraud;

  • deliver or measure advertising where applicable.

Cookies may include session Cookies, which expire after a browser session, and persistent Cookies, which remain for a longer period.

Most browsers allow Users to block or delete Cookies.

Blocking certain Cookies may limit functionality of the Site or Platform.

Where required by applicable law, Producer Logic will provide appropriate choices regarding non-essential Cookies and tracking technologies.

10. ANALYTICS, ADVERTISING, AND MARKETING TECHNOLOGIES

Producer Logic may use third-party analytics, advertising, and marketing technologies to understand usage, measure advertising effectiveness, communicate with potential Customers, and market the Services.

Such providers may use Cookies, pixels, identifiers, or similar technologies in accordance with their respective policies and applicable law.

Producer Logic may use services in categories including:

  • advertising measurement;
  • search advertising;
  • social-media advertising;
  • conversion tracking;
  • customer relationship management;

  • customer engagement.

Producer Logic will update its disclosures as material technologies and providers are implemented or changed.

11.5. Non-Personal Information

Producer Logic may use, disclose, license, analyze, or otherwise process aggregated, anonymized, or de-identified Non-Personal Information for lawful purposes, including research, analytics, product development, and improvement.

12. ACCESS, CORRECTION, AND DELETION OF PERSONAL INFORMATION

Depending upon applicable law and your jurisdiction, you may have certain rights concerning your Personal Information, which may include rights to:

  • request access;
  • request correction;
  • request deletion;
  • request information concerning processing;
  • obtain a copy;
  • restrict certain processing;
  • object to certain processing;
  • opt out of certain communications; or
  • exercise other rights provided by applicable privacy law.

Producer Logic may retain Personal Information for as long as reasonably necessary to:

  • maintain Customer accounts;
  • fulfill the purposes described in this Privacy Policy;
  • comply with contractual obligations;
  • comply with legal and regulatory requirements;
  • resolve disputes;
  • maintain security;
  • prevent fraud;
  • enforce agreements; and
  • establish, exercise, or defend legal claims.

Retention periods may vary depending upon the type of information, purpose of processing, contractual requirements, legal requirements, and technical considerations.

Information contained in backups may remain for a limited period following deletion from active systems.

Aggregated, anonymized, or de-identified information may be retained for longer periods where permitted by law.

14. MINORS

The Producer Logic Platform is a professional business-to-business service intended for insurance professionals and other business Users.

The Platform is not intended for children under sixteen (16), and Producer Logic does not knowingly collect Personal Information directly from children under sixteen.

If Producer Logic learns that it has knowingly collected Personal Information directly from a child under sixteen without appropriate authorization, Producer Logic will take reasonable steps to delete such information.

15. SECURITY

Producer Logic takes commercially reasonable administrative, technical, and organizational measures designed to protect Personal Information against unauthorized access, use, alteration, disclosure, destruction, or loss.

Security measures may include, as appropriate:

  • authentication controls;
  • access restrictions;
  • encryption;
  • secure cloud infrastructure;
  • logging;
  • monitoring;
  • backups;
  • vendor security controls;
  • software-security practices; and
  • internal procedures.

However, no Internet transmission, electronic storage system, cloud service, database, software platform, artificial intelligence system, or security measure is completely secure.

PRODUCER LOGIC CANNOT AND DOES NOT GUARANTEE ABSOLUTE SECURITY OR THAT UNAUTHORIZED ACCESS, HACKING, CYBERATTACKS, DATA LOSS, SECURITY INTRUSIONS, MALWARE, THIRD-PARTY SERVICE FAILURES, OR OTHER SECURITY EVENTS WILL NEVER OCCUR.

To the maximum extent permitted by applicable law and subject to Producer Logic's contractual and statutory obligations, Producer Logic shall not be responsible for security incidents caused by circumstances outside Producer Logic's reasonable control.

Customers are responsible for maintaining appropriate security of:

  • passwords;
  • account credentials;
  • devices;
  • networks;
  • Authorized User access; and
  • Customer-controlled systems.

16. THIRD-PARTY SERVICE PROVIDERS

Producer Logic may use third-party service providers that collect, store, process, transmit, or otherwise handle information on our behalf.

These may include providers of:

  • artificial intelligence and large language models;
  • cloud hosting;
  • databases;
  • authentication;
  • payment processing;
  • analytics;
  • customer support;
  • communications;
  • email;
  • cybersecurity;
  • error monitoring;
  • marketing;
  • advertising;
  • CRM;
  • user onboarding; and
  • software infrastructure.

Third-party providers may operate in jurisdictions with different privacy and data-protection laws.

Producer Logic will use commercially reasonable efforts to select service providers appropriate for its operations.

Users should review applicable third-party privacy policies where relevant.

17. LINKS TO THIRD-PARTY WEBSITES

The Site or Platform may contain links to third-party websites, insurance carriers, MGAs, wholesalers, industry resources, or other services.

Such third-party sites are not controlled by Producer Logic.

Producer Logic is not responsible for:

  • their availability;
  • their privacy practices;
  • their security;
  • their content;
  • their products;
  • their services;
  • their accuracy; or
  • information collected by such third parties.

A link does not necessarily constitute endorsement, sponsorship, affiliation, or recommendation.

Users should review the terms and privacy policies of third-party websites before providing information to them.

18. INTERNATIONAL DATA TRANSFERS

Producer Logic and its service providers may process information in the United States and other countries.

Accordingly, Personal Information may be transferred from your jurisdiction to another jurisdiction that may have different privacy or data-protection laws.

Where required by applicable law, Producer Logic will use legally recognized safeguards for applicable international transfers.

By using the Services and providing information, you acknowledge that information may be processed in jurisdictions other than your own, subject to applicable law.

19. DIRECT MARKETING

Where permitted by applicable law, Producer Logic may use contact information provided by Users to communicate regarding:

  • Producer Logic products;
  • Platform updates;
  • new features;
  • educational materials;
  • commercial-insurance content;
  • webinars;
  • promotions;
  • special offers;
  • related products or services; and
  • other business communications.

Users may unsubscribe from marketing emails by following the unsubscribe instructions contained in such communications or by contacting Producer Logic.

Unsubscribing from marketing communications will not necessarily prevent Producer Logic from sending transactional, account, billing, security, legal, or other non-marketing communications.

20. PAYMENT INFORMATION

We accept certain online payment methods, using our Online Payment Processors, which enable Users to send and receive payments securely online using a credit card or bank account. We may add or change the Online Payment Processors at our sole discretion. Producer Logic is not affiliated with such Online Payment Processors, as each is an independent contractor, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other. The use of the Online Payment Processors is at the User's discretion and sole liability and risk. It is the User's responsibility to abide by all the terms specified by the Online Payment Processors in their terms of use and privacy policies, including but not limited to any age restrictions specified therein. The User acknowledge that he/she is fully assuming the risks of conducting any transactions via the Online Payment Processors.

21. CUSTOMER DATA AND THIRD-PARTY RIGHTS

Customer acknowledges that information entered into the Platform may relate to third parties, including:

  • prospects;
  • insureds;
  • businesses;
  • employees;
  • owners;
  • executives;
  • claimants;
  • carriers;
  • underwriters; or
  • other persons or organizations.

Customer is solely responsible for determining whether Customer is authorized to provide such information to Producer Logic.

Customer shall not use the Platform to unlawfully collect, disclose, process, or transmit Personal Information.

Customer should minimize the amount of Personal Information entered into the Platform and should provide only information reasonably necessary for the intended business purpose.

22. BUSINESS-TO-BUSINESS NATURE OF THE PLATFORM

Producer Logic is designed primarily as a business-to-business technology and decision-support platform for commercial insurance professionals.

The Platform is not designed as a consumer insurance application through which individual consumers purchase, quote, bind, or obtain insurance directly from Producer Logic.

Producer Logic does not sell insurance through the Platform and does not require consumers to submit information directly to Producer Logic for the purpose of obtaining insurance unless Producer Logic expressly introduces such functionality in the future.

23. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy governs use of the Services and information processed as described herein.

Producer Logic reserves the right to update this Privacy Policy from time to time.

If we make material changes, we may provide notice through:

  • the Site;
  • the Platform;
  • email;
  • an account notification; or
  • another reasonable method.

Unless otherwise required by applicable law, changes will become effective as of the "Last Revised" date identified at the beginning of this Privacy Policy.

Continued use of the Services following the effective date of an updated Privacy Policy constitutes acknowledgement of the updated Privacy Policy to the extent permitted by applicable law.
